These Terms and Conditions (“Terms”) govern your access to and use of the BLOUIN Contracting website (the “Site”). By accessing or using the Site, you agree to these Terms.

If you do not agree with these Terms, please do not use the Site.

1. ABOUT BLOUIN CONTRACTING

BLOUIN Contracting provides preconstruction and residential construction services exclusively for acquired or licensed BLOU INK residential concepts.

BLOUIN Contracting operates as a separate business within a connected residential development system that also includes BLOU INK and BLOUIN Properties. Each business performs a distinct role and may maintain its own agreements, policies, terms, and business relationships.

References on this Site to BLOU INK or BLOUIN Properties do not merge the businesses or make one entity responsible for the obligations of another.

2. WEBSITE PURPOSE

The Site provides general information regarding BLOUIN Contracting, BLOU INK residences, the BLOUIN residential development system, construction processes, market areas, and related services.

Content provided on the Site is for general informational and promotional purposes and does not constitute a construction proposal, estimate, bid, guarantee, professional opinion, or contractual commitment.

Information appearing on the Site may change without notice.

3. NO CONSTRUCTION AGREEMENT CREATED BY WEBSITE USE

Accessing the Site, submitting an inquiry, communicating with BLOUIN Contracting, requesting information, or discussing a potential project does not create a construction contract or obligate BLOUIN Contracting to undertake a project.

BLOUIN Contracting does not become contractually obligated to provide preconstruction or construction services unless and until the parties execute an applicable written agreement.

Any actual project undertaken by BLOUIN Contracting will be governed by the executed agreement applicable to that project.

If there is any conflict between information appearing on this Site and an executed written agreement governing a project, the executed agreement will control with respect to that project.

4. PROJECT INQUIRIES AND ACCEPTANCE

Submission of a project inquiry does not guarantee that a project will be accepted.

BLOUIN Contracting may evaluate potential projects based on factors including, but not limited to, concept acquisition or licensing status, project location, site conditions, feasibility, scheduling, availability, permitting requirements, construction requirements, budget considerations, and other project-specific circumstances.

BLOUIN Contracting reserves the right to decline a potential project or determine that a project cannot proceed, subject to any obligations contained in an already executed agreement.

5. BLOU INK RESIDENTIAL CONCEPTS

BLOUIN Contracting construction services are dedicated exclusively to residential concepts acquired or licensed through BLOU INK.

The display of a BLOU INK residence on this Site does not constitute the sale, transfer, assignment, or licensing of that concept or any associated intellectual-property rights.

Acquisition or licensing of a BLOU INK residential concept is governed by the applicable agreement with BLOU INK.

Selection or acquisition of a residential concept does not, by itself, guarantee that the concept can be constructed on any particular property.

Site-specific feasibility is evaluated separately as part of the applicable development and preconstruction process.

6. SITE-SPECIFIC CONSTRUCTION

BLOU INK residential concepts are developed independently of a specific construction site.

Following selection and acquisition of a residence, site-specific considerations may include property characteristics, surveys, soils, topography, utilities, zoning, setbacks, easements, engineering, permitting, code requirements, constructability, material availability, trade availability, pricing, scheduling, and other conditions affecting construction.

Information provided on this Site should not be interpreted as a representation or guarantee that a particular residence can be constructed on a particular site or under particular conditions.

7. BLOUIN PROPERTIES

Where appropriate, visitors may explore property or site opportunities through BLOUIN Properties.

BLOUIN Properties operates separately from BLOUIN Contracting. Property availability, acquisition, development, feasibility, pricing, and related services are subject to separate evaluation and applicable agreements.

Use of BLOUIN Properties is not required when a client already owns or controls an appropriate site, subject to project feasibility and applicable agreements.

8. PRECONSTRUCTION AND CONSTRUCTION INFORMATION

Descriptions on this Site regarding preconstruction, approval, construction, project phases, processes, or anticipated activities are general descriptions of the BLOUIN Contracting approach.

They do not establish the specific scope, price, schedule, responsibilities, deliverables, or contractual obligations applicable to an individual project.

Those matters will be established by the applicable written agreement and project documentation.

9. PRICING, ESTIMATES AND SCHEDULES

Unless expressly included in an executed written agreement, nothing appearing on the Site constitutes a binding price, construction cost, estimate, bid, allowance, schedule, completion date, or financial commitment.

Construction pricing and scheduling may be affected by project-specific circumstances, site conditions, labor and material availability, trade pricing, regulatory requirements, permitting, market conditions, and other factors.

Project-specific pricing, payment obligations, allowances, schedules, and related terms will be governed by the applicable written agreement.

10. INTELLECTUAL PROPERTY

The BLOUIN Contracting name, logo, branding, website design, text, graphics, photographs, renderings, and other original content appearing on this Site are protected by applicable intellectual-property laws and may not be copied, reproduced, distributed, modified, published, displayed, or commercially used without appropriate authorization.

BLOU INK residential concepts and associated intellectual property including drawings, renderings, plans, diagrams, spatial concepts, design materials, specifications, terminology, and related creative works remain subject to BLOU INK's applicable intellectual-property rights.

Nothing on this Site grants any license or right to reproduce, modify, adapt, construct, develop, distribute, sell, or otherwise use a BLOU INK residential concept except pursuant to express written authorization and the applicable agreement.

11. RENDERINGS, IMAGES AND CONCEPTUAL MATERIAL

Architectural renderings, images, drawings, diagrams, plans, and other visual materials appearing on the Site may depict conceptual representations of BLOU INK residences.

Such materials are provided for illustrative purposes and should not be interpreted as final construction documents or guarantees regarding final built appearance, materials, landscaping, furnishings, dimensions, site conditions, or other project-specific characteristics.

Actual construction requirements and approved project documentation will be established through the applicable preconstruction and construction process.

12. THIRD-PARTY PROFESSIONALS AND TRADES

Residential construction may require the involvement of architects, engineers, consultants, licensed trades, subcontractors, suppliers, governmental authorities, inspectors, and other third parties.

References to coordination with such parties do not constitute a representation that any particular third party has been retained for a project unless expressly stated in applicable project documentation or an executed agreement.

13. THIRD-PARTY WEBSITES

The Site may contain links to websites operated by BLOU INK, BLOUIN Properties, social media platforms, mapping services, service providers, or other third parties.

BLOUIN Contracting does not control third-party websites and is not responsible for their availability, content, security, privacy practices, or terms. Accessing a third-party website is subject to that website's applicable policies and terms.

14. ACCEPTABLE USE

You agree not to use the Site:

For unlawful, fraudulent, or abusive purposes
To interfere with the operation or security of the Site
To attempt unauthorized access to the Site or related systems
To introduce malicious software, code, or other harmful technology
To scrape, harvest, systematically extract, or misuse Site content or information
To infringe intellectual-property or other legal rights
To misrepresent your identity or affiliation with another person or entity

15. WEBSITE AVAILABILITY AND ACCURACY

BLOUIN Contracting endeavors to provide useful and accurate information but does not warrant that the Site will always be available, uninterrupted, error-free, complete, or current.

We may modify, suspend, remove, or discontinue portions of the Site at any time.

To the extent permitted by applicable law, use of the Site is at your own risk.

16. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. BLOUIN CONTRACTING DISCLAIMS WARRANTIES REGARDING THE SITE AND ITS CONTENT TO THE EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Nothing in this section modifies or disclaims any warranty or obligation expressly provided in an executed construction agreement or any warranty or right that cannot lawfully be waived.

17. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLOUIN CONTRACTING WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING SOLELY FROM ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THIS SITE.

This limitation applies to website use and is not intended to replace, modify, or govern liability provisions contained in an executed construction or other project agreement.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

18. PRIVACY

Your use of the Site is also subject to the BLOUIN Contracting Privacy Policy. Please review the Privacy Policy for information regarding how personal information may be collected, used, disclosed, and protected.

19. GOVERNING LAW

These Terms and your use of the Site are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

These website Terms do not determine the governing law, venue, dispute-resolution procedure, or other legal provisions applicable to a construction project. Those matters may be addressed separately in the applicable executed agreement.

20. CHANGES TO THESE TERMS

BLOUIN Contracting may modify these Terms from time to time.

Changes will be posted on the Site and reflected by an updated “Last Updated” date. Continued use of the Site following publication of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

21. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
